Clear Channel-Owned Translator Enters Consent Decree With FCC

CLEAR CHANNEL's CAPSTAR TX, LLC has entered into a Consent Decree over unauthorized transfer of, and underwriting announcements aired on, FM translator W300BQ/VERO BEACH, FL and will send a "voluntary contribution" of $11,500 to settle the matter.
W300BQ rebroadcasts BREVARD YOUTH EDUCATION BROADCASTING CORP. noncommercial low power Smooth Jazz WGRV-LP (THE GROOVE)/MELBOURNE, FL, operated by RANDY BENNETT. CAPSTAR admitted in a letter dated JULY 29, 2010 that it had "failed to exercise the requisite control as a permittee and licensee of Station W300BQ" and that "since early 2008, Mr. RANDY BENNETT and/or BREVARD YOUTH EDUCATION BROADCASTING CORPORATION constructed, operated, and controlled the Station without proper documentation of an interim relationship between the parties, and without Commission authorization, until FEBRUARY 26, 2010." In addition, the FCC said that violations of the underwriting laws occurred on three occasions in 2009 and 2010.
Another WGRV-LP translator also drew a fine from the FCC, with ACE OF HEARTS DISC JOCKEY SERVICE, also controlled by BENNETT, getting an $11,000 fine for operating W277AN/CAPE CANAVERAL, FL with unauthorized antenna equipment and over authorized power.
