FCC Proposes $3,000 Fine For Winning Bidder's Late Post-Auction Form 301 Filing

The FCC has proposed a $3,000 fine against JAMES M. LOUT for filing his post-Auction 93 Form 301 late, but has granted his request for a waiver and has accepted his application for filing.
LOUT won the bidding for a new FM construction permit for NEW LLANO, LA, but failed to file his Form 301 by the MAY 29, 2012 deadline. LOUT claimed that he did not get the Closing Notice and thought that he had to wait until getting a receipt for the final auction payment, and then learned of the Form 301 deadline from counsel. The waiver was granted based on good cause shown, namely compliance with all previous requirements and no bad faith involved.
