Schnitt Lawyers Ask For Mistrial, Allege Attorney's DUI Was A Setup By Bubba's Lawyers

The arrest of TODD SCHNITT's attorney prompted SCHNITT's other attorneys to ask the court FRIDAY (1/25) for a mistrial in his suit against BUBBA THE LOVE SPONGE, reports CBS affiliate WTSP-TV/ST. PETERSBURG-TAMPA.
While the judge is allowing the trial to continue while he reserves judgment on the mistrial motion, the case was sent into a new direction with allegations that a legal assistant for the law firm representing defendant BUBBA was with SCHNITT's attorney CHARLES PHILIP (PHIL) CAMPBELL at the time of his arrest on a DUI charge and may have held onto CAMPBELL's briefcase when he was taken into custody.
MELISSA PERSONIUS, a legal aide at the law firm representing BUBBA, refused to answer questions under oath about the situation, invoking the Fifth Amendment. SCHNITT's attorneys allege that PERSONIUS got CAMPBELL drunk at TAMPA restaurant MALIO'S and called the police on him, and that PERSONIUS never told CAMPBELL that she worked for the law firm and set CAMPBELL up by asking him to move her car after drinking with him. The TAMPA BAY TIMES reports that PERSONIUS said she didn't tell CAMPBELL about her employment because "you don't give your personal true information to anyone you don't know." JONATHAN ELLIS, another attorney for SCHNITT, said that PERSONIUS told CAMPBELL she worked for another law firm.
STEPHEN DIACO, brother of BUBBA's attorney JOSEPH DIACO, also testified but said he did not recall if he had asked someone from his law firm to call the police on CAMPBELL. TAMPA Police DUI Sgt. RAY FERNANDEZ testified that one of DIACO's attorneys. ADAM FILTHAUT, called the police with the tip on CAMPBELL.
