FTC Opposes Proposed Tennessee Attorney Ad Restrictions

The FEDERAL TRADE COMMISSION has filed comments with the TENNESSEE Supreme Court asking that the state bar not add new restrictions on attorney advertising that would, among other things, ban some background signs, actors playing clients, well-known spokespersons, and some images in video and print ads.
THE BLT: THE BLOG OF LEGAL TIMES reports that the FTC comments tell the court that "Imposing overly broad restrictions prevents the communication of truthful and non-misleading information that some consumers may value, which is likely to inhibit competition and frustrate informed consumer choice ... More narrowly tailored rules would better address the concerns underlying the proposed regulations. For example, requiring a clear and prominent disclosure that actors are portraying clients would be a less restrictive way to alleviate any concern about potential deception."
