FCC Affirms Interference Fine Against California FM Translator

The FCC has rejected the Application for Review by PLAYA DEL SOL BROADCASTERS of a $4,000 fine for interference caused to the VHF aviation band by FM translator K238AK/PALM DESERT, CA.
The station, which rebroadcasts Top 40 KRCK (HOT HITS 97.7)/MECCA-INDIO-PALM SPRINGS, CA, was fined for failure to properly attenuate its emissions, resulting in interference to RIVERSIDE COUNTY Sheriff's helicopters. PLAYA DEL SOL contended that the violations were not willful or repeated, but the Commission defined the three simultaneous unauthorized emissions as separate violations and defines "willful" as knowing what one is doing even if one doesn't intend to violate the law.
