Judge Denies Renda's Motion To Dismiss Arbitron Suit

U.S. District Court Judge MARCIA HOWARD has denied RENDA BROADCASTING CORP.'s motion to dismiss the lawsuit brought against it by ARBITRON, INC. (now NIELSEN AUDIO) over unauthorized use of ratings information.
RENDA argued that ARBITRON's amended complaint, filed after its initial complaint was dismissed, "fails to set forth plausible grounds for relief for copyright infringement and contributory infringement," alleging "sweeping legal conclusions" and having various deficiencies, including failure to identify the agency from which RENDA allegedly got the numbers and lumping together multiple claims.
The judge rejected RENDA's arguments and decided that ARBITRON's filings sufficiently stated a claim.
