The U.S. Court of Appeals for the DISTRICT OF COLUMBIA has been picked to hear the NAB and PROMETHEUS RADIO PROJECT's challenges to the FCC's new restrictions on television joint sales agreements and newspaper/broadcast cross-ownership prohibitions, reports BROADCASTING AND CABLE.
PROMETHEUS sought to have the appeal heard in the Third Circuit in PHILADELPHIA, the court that originally remanded the ownership rules review back to the FCC; The NAB preferred the D.C. court, and won the lottery that determines where appeals of the same case will be heard.
PROMETHEUS is likely to move to have the case transferred to the Third Circuit.
