Class Action Suit Targets Arbitron/Nielsen Robocalls

A suit has been filed in U.S. District Court in NORTHERN CALIFORNIA against ARBITRON, INC. (now NIELSEN AUDIO) over the latter's calling and messaging consumers without permission. The suit was filed by BEVERLY HILLS attorney TODD M. FRIEDMAN's firm with ALFREDO LEON OREA as named plaintiff.
OREA's suit alleges that he was called numerous times and was left "scripted messages" in automated or "robotic" voices soliciting him to participate in a TV and radio ratings survey, in violation of the Telephone Consumer Protection Act.
While the opening of the suit alleges that his cell phone was called, the factual allegations say that he was called on his residential phone, which is on the "Do Not Call" list. The suit seeks damages and injunctive relief against the company.
