FCC Hits WXNY/New York With Fine For Airing Fake EAS Tones

UNIVISION LOCAL MEDIA, INC. Spanish Top 40/Rhythmic WXNY (X 96.3)/NEW YORK has drawn a $20,000 fine from the FCC for airing fake EAS tones during the LUIS JIMENEZ morning show. The station will also institute a three-year compliance and reporting plan at all UNIVISION radio stations.
The fine, levied in a consent decree, arose from a JANUARY 28th, 2014 show when JIMENEZ aired a comedy bit that included repeated airings of the tones along with acknowledgement from the personalities that doing so was illegal.
Enforcement Bureau Chief TRAVIS LEBLANC said, “The American public relies on the emergency alert system to inform them of real emergencies. Misuse of the emergency alert system desensitizes the public to the importance of the tones and poses a serious danger to the nation’s public safety, whether those tones are transmitted with programming that is in English, Spanish, or any other language.”
