Two Michigan Stations Fined By FCC

BIRACH BROADCASTING CORP. has been fined $17,000 for tower fencing and public file violations at Oldies WCXI-A (OLDIES 1160)/FENTON, MI. The licensee argued that it does not own the tower site and that the issues/programs lists that were missing from the public file were not in fact missing but were "just improperly organized"; the Commission rejected the arguments and upheld the previously proposed fine with no reduction or cancellation.
The Commission also upheld a $22,000 fine against R.J.'S LATE NIGHT ENTERTAINMENT CORP. for EAS and public file violations and transmitting from an unauthorized location at noncommercial Urban-Talk WHPR/HIGHLAND PARK, MI. The Commission said that the licensee failed to timely respond to a Notice of Apparent Liability; even though the licensee responded to the wrong office (WASHINGTON instead of DETROIT), the Commission considered its argument that it had no intent to violate the rules and rejected them as insufficient to reduce or cancel the penalty, as were subsequent corrective measures.
