Emmis Challenges FCC's Approval Of Indianapolis-Area Translator Sale To iHeartMedia

EMMIS RADIO LICENSE LLC has filed a challenge to the FCC's grant of the sale by EDUCATIONAL MEDIA FOUNDATION of W248AW/FRANKLIN, IN to iHEARTRADIO's CAPSTAR TX LLC for $275,000. The primary station is listed on EMF and iHEART's application as Classic Rock WFBQ (Q95)/INDIANAPOLIS, which airs sister Sports WNDE-A on its HD2 channel.
In its petition for reconsideration, EMMIS charges that the use of WFBQ as the named primary station violates one of the special operating conditions places on the construction permit for W248AW and that either the translator needs to specify WNDE as the primary station or the permit should be surrendered. The condition that the translator rebroadcast an AM station for four years was placed on the permit to allow it to get a MATTOON Waiver to move into INDIANAPOLIS as a "minor change" despite the old and new contours not sufficiently overlapping.
