Station Sale Leads To Lawsuit In Sioux Falls

The SIOUX FALLS ARGUS LEADER is reporting that JOHN SMALL's CUP OF DIRT is suing entrepreneur CHUCK BRENNAN over what it says was the premature announcement of the sale of its '80s Oldies KZOY and K221FO (SUNNY 92.1)/SIOUX FALLS, SD to BRENNAN's BADLANDS AIRTIME, LLC (part of his BADLANDS PAWN, GOLD & JEWELRY) for $1.5 million and problems with payments for the station.
The suit alleges that BRENNAN announced the deal on DECEMBER 26th before it was final, leading to staff defections, and is battling over whether a first payment placed in escrow should have been transferred to SMALL's account or should be returned to escrow.
The parties are meeting to try to come to a resolution, and SMALL told the paper that he remains a fan of BRENNAN's BADLANDS PAWN project and wants "to do what’s best for everyone," while BRENNAN said that he and SMALL are "long-time friends" and "We're pretty confident that both sides would like to resolve this conflict amicably."
