FCC Fines E-String Wireless For Falsely Certifying Statements In Application But Grants Translator Sale
E-STRING WIRELESS, LTD. has been found liable by the Commission for a $9,000 fine for false certification and unauthorized operation of K298CB (formerly K299BN)/BEAUMONT, TX but approved the translator's sale to MARTIN BROADCASTING, INC. for $70,000. The translator underwent several frequency and site changes since E-STRING initially filed for the construction permit, and SOUTHEAST TEXAS TELECOM, LLC objected to the sale to MARTIN, alleging that E-STRING "willfully made false statements" in the applications, specifically about the availability of tower sites. The initial application, STT alleged, used a tower that had been destroyed by Hurricane RITA and a picture in the application was of a different tower. STT also alleged that the translator was operated with parameters different from the authorized facilities. E-STRING said that the misstatements were inadvertent errors, and that it was unaware the first tower had been destroyed until STT's filing.
The Commission ruled that the technical changes were final and will not be reopened, and fined E-STRING $5,000 based on certifying the truth of the applications when they contained misstatements and $4,000 for operating at variance with the authorized parameters, but found that the violations were not intentional and did not rise to the level of misrepresentation or lack of candor. The sale to MARTIN will also be granted, absent any additional issues in that separate proceeding.
