FCC Rescinds Grant Of Nomcommercial FM Permit

The FCC has granted an Application for Review by CHEHALIS VALLEY EDUCATIONAL FOUNDATION and has rescinded its grant of a new noncommercial FM to THE KBOO FOUNDATION at CHEHALIS, WA.
KBOO and CVEF were competing applicants in a mutually exclusive group, and while awaiting Commission action, KBOO filed an amendment to its Board membership that qualified as a major change, and thus outside a filing window, but KBOO requested a waiver of that rule, which was granted. When another applicant won the pool for a permit, KBOO appealed, noting that it had reached a settlement with other applicants and could now be approved as a singleton. CVEF appealed, the appeal was denied by the Media Bureau, and it filed an Application for Review.
The Commission decided that the waiver request required a "hard look" analysis and needed a showing of good cause; KBOO's argument, it said, failed to demonstrate "special circumstances" justifying the waiver.
