Another lawsuit has been filed against SIRIUSXM alleging violations of the Telephone Consumer Protection Act as well as the FLORIDA Deceptive Unfair Trades Practices Act.
MARK J. JACOBBI, a self-professed "registered member of the FLORIDA No Call List," filed the suit on his own behalf in U.S. District Court for the Middle DIstrict of FLORIDA, JACKSONVILLE Division, alleging violations of the telemarketing/anti-robodialing law as well as charging that SIRIUSXM had failed to registed as a "Foreign Corporation" with the state of FLORIDA and therefore illegally transacted business in the state. JACOBBI's suit claims that SIRIUSXM called his cell phone on five occasions in AUGUST and NOVEMBER of 2015 and left messages.
JACOBBI is demanding $59,500 for statutory and punitive damages, $50,000 of which would be the punitive portion.
