WSKQ (Mega 97.9)/New York License Renewed After Challenge Denied

The FCC has renewed the license of SPANISH BROADCASTING SYSTEM for Tropical WSKQ (MEGA 97.9)/NEW YORK over two Petitions to Deny filed in 2006 and 2014 by AGUSTINA PEREZ, Rev. Mr. GILBERTO VASQUEZ, MARTA GARCIA, the NATIONAL HISPANIC MEDIA COALITION, and the CATHOLIC COMMUNITY OF ST. AGNES ROMAN CATHOLIC CHURCH of PATERSON, NJ. The Commission denied the 2006 petition, dismissed the 2014 petition, and granted the renewal.
The parties challenged the renewal over the station's morning show EL VACILON DE LA MAÑANA and alleged indecency and hoax broadcasts. The Commission said that even if the facts alleged in the 2006 petition were to be determined to be indecent, that alone would not justify denial or designation of the renewal application, and the hoax broadcast -- a 2001 "report" that the LINCOLN TUNNEL was flooded -- was not proven to either have been broadcast as alleged (only a mention in the NEW YORK TIMES was offered as evidence) nor to have caused public harm.
