Settlement Conference Set For Nielsen-Flinn Case

The settlement conference for NIELSEN AUDIO and FLINN BROADCASTING in their legal dispute over unpaid fees has been set for MAY 11th by U.S. Magistrate Judge J. MARK COULSON. The parties have been asked to submit ex parte letters by APRIL 27th explaining what facts they can prove at trial and the opposing case's weaknesses.
Separately, Judge ELLEN HOLLANDER has approved extending NIELSEN's time to file an answer to FLINN's counterclaims, giving NIELSEN until APRIL 15th to file, extended from APRIL 1st.
NIELSEN's suit alleges that FLINN did not pay fees totaling $136,872.88 due under a 2013 contract for ratings in the MEMPHIS market, plus late fees at 1.5% per month ($16.287.12 through MARCH 14th, 2016) and attorney's fees of $22,974. FLINN has counterclaimed, alleging flaws in the PPM methodology, and seeks damages from breaches of 2010, 2012, and 2013 agreements of at least $297,816, $190,975, and $213,739, respectively, plus costs and attorney's fees.
