Cumulus Moves To Transfer, Dismiss TRN Suit

CUMULUS MEDIA has responded to the suit filed by TALK RADIO NETWORK ENTERPRISES against it, WESTWOOD ONE, COMPASS MEDIA NETWORKS, WYD MEDIA MANAGEMENT/WYM MEDIA MANAGEMENT, LEW DICKEY, and CHARLES STEINHAUER in U.S. District Court for the MEDFORD Division of OREGON with a motion to dismiss based on a previous case against WESTWOOD ONE predecessor DIAL GLOBAL and a motion to transfer venue to Central CALIFORNIA.
CUMULUS asked the court to seal the motions as well as supporting declarations from LEW DICKEY and STEINHAUER that include a Sales Representation Agreement and Settlement Agreement between them; the motion to seal was unopposed and granted TODAY.
As first reported by ALL ACCESS (NET NEWS 4/11), TRN's suit claims CUMULUS and WESTWOOD ONE are monopolizing or attempting to monopolize the independent national syndication advertising representation market, and that WYD and WYM are "operated in collusion" with CUMULUS and WESTWOOD ONE. TRN is seeking treble damages and permanent injunctive relief, plus exemplary and punitive damages and interest.
