Judge Rules Johnny Burke And Blondie Can Continue Online Show

JOHNNY BURKE AND BLONDIE, the former CUMULUS Classic Hits WHNN/SAGINAW morning team, can continue to stream a show online, U.S. District Judge THOMAS H. LUDINGTON ruled FRIDAY (7/15).
The ruling hands JOHNNY BURKE and BONNIE "BLONDIE" BELGER-HOLZHEI a victory in CUMULUS' attempt to enforce a noncompete provision in the hosts' contracts, filed after BURKE and BELGER-HOLZHEI sued the company alleging age discrimination. However, the BAY CITY TIMES reports that while the judge ruled that the Internet and Periscope show "is not a radio station" for purposes of the contract provision, BURKE and HOLZHEI may not solicit current and former CUMULUS advertisers and may not mention WHNN in promotional material or online, and may not use specific segments used on the WHNN show like "Tweet of the Day."
And the judge denied CUMULUS' attempt to block BELGER-HOLZHEI from using her air name BLONDIE.
