Radio One Sued Over Alleged Unsolicited Telemarketing Text Messages

RADIO ONE is being sued in U.S. District Court for the Northern District of GEORGIA (ATLANTA Division) over what the plaintiff calls unsolicited text messages sent to his phone.
The suit, filed by WAYNE H. NORMAN against RADIO ONE ATLANTA, LLC d/b/a WHTA (HOT 107.9 FM)/ATLANTA, alleges that RADIO ONE has "sent out millions, if not billions of unlawful text messages" in violation of the Telephone Consumers Protection Act of 1991.
He claims that he was at an event sponsored by HOT 107.9 and was told by a representative to text the word "HOT" to a number to enter a contest but that further texts, 91 in all, were sent to his phone without his consent; he alleges that the FCC requires "prior express written consent" for all automated telemarketing calls to cell phones, including text messages. NORMAN is seeking treble damages of up to $1,500 per text violation.
