War Over Winches: Host Sues Citadel To Escape Non-Compete

Former CITADEL Sports WJOX-A/BIRMINGHAM host HERB WINCHES has gone to court to get back on the air at crosstown CLEAR CHANNEL Talk WERC-A, filing a civil suit against CITADEL and seeking a temporary restraining order, reports the BIRMINGHAM BUSINESS JOURNAL.
WINCHES exited WJOX in DECEMBER after learning that CITADEL would be moving WJOX to FM and leaving WINCHES on the AM, now Sports WSPZ-A. WINCHES wants a permanent injunction to prevent CITADEL from restricting his employment in the market and also is asking the court to declare his WJOX show title ("THE BIG TIME WITH HERB WINCHES") as his intellectual property.
WINCHES says that CITADEL is attempting to exercise exclusivity over his employment through DECEMBER 20, 2007 and, as a result, his prospective next employer (presumably WERC) is not willing to continue negotiations with the non-compete in the air. A hearing is scheduled for FEBRUARY 20.
