CC, Cumulus Square Off On Morning Show Contract

QUAD CITIES ONLINE reports former CLEAR CHANNEL Classic Rock KCQQ (Q106.5)/QUAD CITIES morning duo DWYER & MICHAELS thought that when they left the QUAD CITIES (NET NEWS 1/3) last month to work in CEDAR RAPIDS they would be avoiding violating their non-competition clause.
The lawyers at CLEAR CHANNEL think otherwise.
DWYER, MICHAELS and ELIZABETH "BETH DAVIS" MACHAEL are broadcasting on CUMULUS Active Rock KRNA/CEDAR RAPIDS. They plan to return to the QUAD CITIES to begin their morning show on CUMULUS' WXLP.
The lawsuit states the "DWYER & MICHAELS Morning Show" has been violating the provision by "physically broadcasting" from CUMULUS' DAVENPORT studio, promoting the show in the QUAD CITIES via print ads, a blog and interviews with QUAD CITIES media.
The lawsuit also names CUMULUS as a defendant, claiming the radio broadcaster is also violating the agreement by employing the trio. The lawsuit states CLEAR CHANNEL would be "irreparably harmed" if all parties are allowed to continue to broadcast.
