Dwyer & Michaels Allowed To Stay On Air

An temporary injunction that would have kept the "DWYER & MICHAELS Morning Show" from broadcasting on CEDAR RAPIDS, IA airwaves has been denied by a SCOTT COUNTY judge.
Judge GARY MCKENRICK issued a written decision yesterday allowing GREG DWYER, BILL MICHAELS and news announcer ELIZABETH MACHAEL to continue to broadcast on CUMULUS Rock KRNA. The trio was being sued by their former employer, CLEAR CHANNEL, which argued that broadcasting the show from the CUMULUS building in DAVENPORT -- as well as advertising and promoting the show in the QUAD CITIES -- was a violation of their "non-compete" clause with CLEAR CHANNEL.
The judge wrote that the CEDAR RAPIDS station area is not considered to be within the QUAD CITIES ADI. The non-compete clause specified the trio couldn't broadcast in the local "area of dominate influence."
