Following up on the FORBES.COM report WEDNESDAY that DON IMUS plans to sue CBS RADIO for the $40 million remaining on his contract, a report at CNN quotes the relevant contract language that appears to acknowledge that the company was aware of, and desired, the host's "irreverent, topical, controversial" material.
The contract language cited by CNN reads, "Company acknowledges that Artist's services to be rendered hereunder are of a unique, extraordinary, irreverent, intellectual, topical, controversial and personal character and that programs of the same general type and nature containing these components are desired by Company and are consistent with Company rules and policies."
Attorney MARTIN GARBUS confirmed to CNN that he has been hired to represent IMUS in a breach of contract suit against CBS. IMUS was fired on APRIL 12 after his "nappy-headed hos" comment about the RUTGERS women's basketball team became the focal point of a media uproar.
