Kohl Asks FCC, DOJ To Block Sirius-XM Merger

Count Sen. HERB KOHL (D-WI) on the side of those opposed to the SIRIUS-XM merger. The Chairman of the Senate's antitrust subcommittee sent a letter to the JUSTICE DEPARTMENT's THOMAS BARNETT and FCC Chairman KEVIN MARTIN asking them to oppose the merger as "unacceptable under antitrust law and as a matter of communication policy."
KOHL's panel has heard testimony from SIRIUS CEO MEL KARMAZIN and others claiming that the relevant market for the merging companies is all audio delivery sources, but KOHL says that "no other technology available today is a substitute for the satellite radio" and that future technologies won't protect consumers from higher prices now.
