BRITISH-based digital audio broadcaster MUSIC CHOICE has won a legal victory over the ownership of its trademarked logo, winning the highest-ever costs order ever made by the U.K. Trade Marks Registry. The judgment confirms MUSIC CHOICE as the rightful owner of its distinctive red and white bulls-eye logo, following a four-year challenge by U.S. retailer TARGET.
TARGET, which operates about 1500 stores in the U.S., claimed that it was the true owner of the rights to MUSIC CHOICE's bulls-eye device. But the Trade Marks Registry disagreed calling TARGET's case "hopeless" and ruling in MUSIC CHOICE's favor.
