Judge Boots School's Suit Against KABC

A lawsuit filed by a LOS ANGELES charter school and its head against CITADEL Talk KABC-A/LOS ANGELES and morning host DOUG MCINTYRE has been tentatively dismissed by a Superior Court judge.
The suit was another chapter in the ongoing battle between the school and the station, which has been critical of ACADEMIA SEMILLAS DEL PUEBLO and administrator MARCOS AGUILAR for allegedly espousing a Mexican nationalistic agenda to children aimed at teaching them to take CALIFORNIA back from the U.S. The battle included an incident in which a man aimed his car at a KABC reporter and also grabbed the reporter's audio tape at the school.
AGUILAR sued the station for slander and civil rights violations, alleging that MCINTYRE incited violence against the school including a bomb scare, but judge RALPH W. DAU said that MCINTYRE's comments were protected opinion and not a command to incite violence.
