European Court Advisor Backs Lower Court Ruling On Sony-BMG Deal

An Advocate General for the EUROPEAN COURT OF JUSTICE told the court that it should uphold the Court of First Instance's ruling that found the EUROPEAN COMMISSION had erred in approving the merger of SONY and BMG's music businesses.
JULIANE KOKOTT of GERMANY told the court that the lower court had in 2006 "rightly held that there had been a failure to state reasons and a manifest error of appraisal in the Commission's decision."
The ruling does not affect SONY-BMG, which won re-approval of the merger in OCTOBER after a resubmission of the plans and a more thorough review by the Commission.
