Victory Files Suit Against Virgin/EMI

VICTORY RECORDS has filed a federal lawsuit against VIRGIN/EMI, alleging that its improperly induced HAWTHORNE HEIGHTS to repudiate its contract with the independent label. The suit, filed in federal court in the Southern District of NEW YORK, seeks $10 million in compensation and $25 million in punitive damages for VIRGIN/EMI's "willful, wanton and deliberate conduct."
The suit alleges that VIRGIN/EMI paid the band $55,000 to fund the initial phase of a 2006 lawsuit and find legal representation. VICTORY further contends that the band's lawsuit and public campaign against the label hurt sales of its second album on VICTORY.
As fate would have it, HAWTHORNE HEIGHTS has never recorded an album for VIRGIN EMI; nonetheless the suit contends that "the band's relationship with VICTORY has been irreconcilably cloven."
