Suit Against KABC Formally Dismissed

A Superior Court judge has formally dismissed a lawsuit filed by a LOS ANGELES charter school and its head against CITADEL Talk KABC-A/LOS ANGELES and morning host DOUG MCINTYRE. Judge RALPH W. DAU had tentatively dismissed the case in NOVEMBER and issued his final ruling THURSDAY (1/10).
The suit by ACADEMIA SEMILLAS DEL PUEBLO followed heavy criticism of the school and administrator MARCOS AGUILAR by KABC and MCINTYRE, who took the school to task for allegedly espousing a Mexican nationalistic agenda to children aimed at teaching them to take CALIFORNIA back from the U.S. At one point, a man allegedly aimed his car at a KABC reporter and also grabbed the reporter's audio tape at the school.
AGUILAR sued the station for slander and civil rights violations, alleging that MCINTYRE incited violence against the school including a bomb scare, but the judge ruled that "no reasonable listener would have concluded that Mr. McIntyre was seriously and literally maintaining that ACADEMIA SEMILLAS DEL PUEBLO was a reconquista grade school."
