NAB To Sue FCC In Cross-Ownership Rule Challenge

The NAB will take its challenge to the FCC's cross-ownership rules to court, filing suit in the D.C. Circuit in another legal challenge to the Commission's recent move to loosen the rules. NAB spokesman DENNIS WHARTON told BROADCASTING AND CABLE that "the decision was arbitrary and capricious" and the NAB will file as early as the end of the day today.
The NAB's challenge is based on the organization's belief that the FCC did not justify why it merely loosened rather than eliminated the rule. The legal challenge in the Third Circuit by PROMETHEUS RADIO and MEDIA ACCESS PROJECT was based on the loosening being unjustified.
