FCC Returns Fox Indecency Appeal On Procedural Grounds

The FCC has returned FOX ENTERTAINMENT GROUP's Petition for Reconsideration of the $91,000 indecency fine levied against several FOX affiliates for airing the TV show "MARRIED BY AMERICA" because the filing exceeded the page limit and, as such, was not filed 10 days before the deadline. FOX had earlier filed a petition in the same case that exceeded the page limit, but the Commission accepted that filing without comment.
The FCC is likely to file suit to try and collect the fines levied for the APRIL 2003 telecast; the forfeiture order was issued FEBRUARY 22 but the stations did not pay the fines by the end of the 30-day payment period.
