The judge in the trial of former ORANGE COUNTY Sheriff MIKE CARONA formally ruled that the trial will not be moved, rejecting the defense's assertion that the "Taint the Jury Pool" campaign by CLEAR CHANNEL Talk KFI-A/LOS ANGELES hosts JOHN AND KEN would make a fair trial in SOUTHERN CALIFORNIA impossible.
JOHN AND KEN have been reading transcripts from tapes of conversations between CARONA and his then-assistant DON HAIDL discussing hiding evidence of taking money and gifts, with CARONA allegedly trying to get HAIDL to lie before a grand jury; the hosts have been urging listeners to get on the jury to convict CARONA and deny having heard the show if asked during voir dire.
But U.S. District Judge ANDREW GUILFORD said, "The advocates of such lawlessness are not nearly as important as they pretend and their listeners are not the gullible audience they suppose. The court will not overreact to bait offered by largely satirical commentators."
