Alabama Sues Drummer Mark Herndon

The TENNESSEAN is reporting that RANDY OWEN, TEDDY GENTRY and JEFF COOK of the legendary Country group ALABAMA are suing drummer MARK HERNDON, claiming that he was overpaid $202,670.
The lawsuit, filed MAY 9th in the CIRCUIT COURT of DeKALB COUNTY, AL, claims that "in 2003 MARK HERNDON was paid for his share of net merchandise sales during the band's "AMERICAN Farewell Tour" before a final accounting was done." Results after final accounting showed that "there were no net merchandise revenues as defined by the contract."
The lawsuit also states that HERNDON has demanded a payment of $65,047, which is his share of an advance against anticipated sales of their live farewell tour CD, "The Last Stand."The album is currently being sold in CRACKER BARREL stores nationwide.
