XM SATELLITE RADIO and SIRIUS SATELLITE RADIO attorneys have responded to the CONSUMER COALITION FOR COMPETITION IN SATELLITE RADIO (C3SR), which continues to demanded FCC hearings on the proposed XM-SIRIUS merger, claiming documents submitted by SIRIUS concerning interoperable receivers were less than truthful.
The letter, signed by attorneys for XM and SIRIUS, says the "NAB Coalition" (which is how C3SR is referred to throughout the letter) is ignoring an "inconvenient truth" -- that the FCC required XM and SIRIUS to design an interoperable radio and certify that they had done so.
The letter is a response to a MAY 27th C3SR filing (NET NEWS 5/27), asking for a hearing. The XM-SIRIUS letter says C3SR's MAY 27th filing "is replete with misstatements of law and false allegations regarding the purpose and production of certain highly confidential documents."
