The FCC has granted the sale of Classic Rock KSNQ (THE SNAKE)/TWIN FALLS, ID by INTERMART BROADCASTING to GAP BROADCASTING TWIN FALLS LICENSE LLC. The Commission denied Petitions to Deny by ASTOUNDING PRODUCTIONS INC. against the transfer of INTERMART from JAMES E. MARTIN, JR. to PATRICIA WOODS and the sale to GAP; ASTOUNDING alleged that INTERMART had posed as a front for CLEAR CHANNEL in the original bidding for the license, and claimed that its appeal to federal court of its loss in the auction makes the assignment applications premature.
The FCC ruled that ASTOUNDING lacked standing to object to the sale, and would have lost anyway, because the Commission routinely grants approval to transactions that may be subject to subsequent court rulings in the absence of a stay or injunction preventing a transfer.
In the matter of the sale of Spanish Hits WIAC-F (SISTEMA 102.5 FM)/SAN JUAN by LUIS A. MEJIA to MSG RADIO INC,, the commission granted the sale but fined the parties $3,000 each for failing to submit all of the required documentation of the deal.
