A CENTRE COUNTY District Attorney's office investigation has concluded that police were justified in shooting and killing a man in a shootout JULY 25th in the parking lot of CENTRAL PENNSYLVANIA CHRISTIAN INSTITUTE Religion WTLR/STATE COLLEGE, PA.
DA MICHAEL MADEIRA said TUESDAY that his office concluded, "based upon all of the information we’ve received, from multiple witness accounts and the state police forensic unit, that the officers involved in this shooting were justified."
BRIAN E. NIEMAN, 50, of POTTERSDALE, PA, was shot to death by FERGUSON TOWNSHIP police after he advanced towards them in his FORD Bronco, shooting at them with a shotgun, refusing orders to stop and ramming their cruisers while trying to run the officers over.
MADEIRA said that NIEMAN never complied with any of the police officers' requests and said at least twice that he would kill the officers, who saw two shotguns and a .30-caliber rifle in NIEMAN's vehicle. "These officers did what they could, and acted professionally," said NIEMAN.
