FCC Rejects Challenge To Emmis Renewals

The FCC has rejected DAVID EDWARD SMITH's petition for reconsideration of the denial of his challenge to the license renewals of EMMIS Sports WFNI-A (1070 THE FAN) and AC WYXB (B105)/INDIANAPOLIS, Country WLHK (97.1 HANK FM)/SHELBYVILLE-INDIANAPOLIS, IN, and Classic Rock WWVR (105.5 THE RIVER) and Country WTHI-F (HI-99)/TERRE HAUTE.
SMITH, the gadfly who tangled with former EMMIS Alternative WKQX (Q101)/CHICAGO morning man MANCOW MULLER, had alleged in 2004 that EMMIS' airing of indecent programming and support of MULLER's SLAPP lawsuit against SMITH should prevent the stations' license renewals. The Commission pointed out that EMMIS had entered a consent decree regarding the indecency and that the FCC does not regulate the non-broadcast activities (such as the lawsuit) of station employees.
