TIMES SQUARE’s "Naked Cowboy" street performer has sued CLEAR CHANNEL, claiming Top 40 WFLZ/TAMPA infringed his trademarked image by creating and promoting an imposter.
ROBERT BURCK, a guitar player who performs wearing only a cowboy hat, boots and tidy whities, claims FLZ created its own "Naked Cowboy" who has appeared in videos and made promotional appearances.
"The imposter has performed in a manner which not only unfairly trades upon, but also tarnishes the goodwill generated by the Naked Cowboy during the course of his career as an entertainer," according to BURCK’s lawsuit filed yesterday in federal court in NEWARK, NJ.
