FCC Rejects Two Appeals

The FCC has rejected MARK HIMMLER's Petition for Reconsideration of its decision denying his application for a new AM station in WATERFORD, PA. HIMMLER's filing of Section 307(b) supplemental information was deemed to have been filed one day after the extended filing deadline of OCOBER 31, 2005. HIMMLER said he sent the information by overnight mail four days earlier but that it was delivered late.
The Commission also rejected POWELL MEREDITH COMMUNICATIONS COMPANY's objection to the Audio Division finding a dispositive preference for RAMS III over POWELL MEREDITH and eight other mutually exclusive applicants for a new AM under Auction 84. RAMS III applied for a new AM at DRAPER, UT in the proceeding, and POWELL MEREDITH objected on the grounds that DRAPER is not independent from the SALT LAKE CITY and PROVO-OREM markets; the objection was dismissed as late-filed.
