PINK FLOYD has won its case against EMI, as a British court ruled YESTERDAY (3/11) in favor of the band in their suit to prohibit EMI from selling individual tracks from its albums online. The lawsuit was filed last SPRING, when the band asked the court to rule on a clause in its contract that "expressly prohibited" EMI from selling single tracks from albums like "Dark Side of the Moon" and "The Wall."

EMI's position that the clause only applied to physical sales and not digital tracks didn't fly with the judge, who said the contract clause was designed to allow the group to "preserve the artistic integrity of the albums." The judge also ordered EMI to cover the band's legal costs.

THE NEW YORK POST reports PINK FLOYD "doesn't seem to be against new ways of marketing its back catalog, which is consistently among the best selling in music. An upcoming episode of CBS' 'Cold Case,' for instance, includes seven songs."

It's been a rough week for EMI, with this ruling coming just a day after the resignation of CEO ELIO LEONI-SCETI (NET NEWS 3/10) and a report that PINK FLOYD and labelmate QUEEN were seeking to exit EMI (NET NEWS 3/10).
