Scott And BR: XX 1090 Breached Our Contract
March 16, 2010 at 4:39 AM (PT)
SCOTT KAPLAN and BILLY RAY SMITH are talking about their absence from mornings at BCA Sports XEPRS-A (XX 1090)/SAN DIEGO on their website, saying that they were ordered to take a pay cut by the station in violation of their contracts.
The statement posted at THESCOTTANDBRSHOW.COM reads, "We hate the idea of not being on the air with you. The AZTECS and the NCAA tourney, LT to the JETS, the new-look PADRES -- good stuff to talk about.
"But there's a problem, and it never should have been a problem.
"In JANUARY, Mr. (JOHN) LYNCH, the CEO of XX, decided he wasn't going to pay us according to our contracts. He asked us if that was going to be okay -- we said no -- and he shorted our checks anyway.
"Our feeling is this:
"You sign a contract, you work according to the contract and you are paid what the contract says you should be paid.
"Without boring you with contract law, Mr. LYNCH breached our agreement.
"JOHN LYNCH gave us clear choices ... in writing! We were free to leave, or we could work for less than we are entitled to contractually. We chose the former.
"In closing, this statement is brought to you by (longtime sponsors) CORKY'S PEST CONTROL, BOB BAKER TOYOTA, FLO TV, HAWAIIAN AIRLINES, SKINIT.COM, SLEEP TRAIN, NATURE BEE, and MOUNTAIN TRUST MORTGAGE SERVICES."
LYNCH has claimed that the hosts tried to exit their contract early and may be headed to another station. The station's DARREN SMITH and MARTY CASWELL are filling in for the time being.
