Judge Rejects Defamation Suit Against New Jersey 101.5

A federal judge has dismissed a lawsuit brought by a photographer against MILLENIUM RADIO GROUP, Talk WKXW (NEW JERSEY 101.5)/TRENTON former afternoon co-host CRAIG CARTON, now morning co-host at CBS RADIO Sports WFAN-A/NEW YORK,, and afternoon co-host RAY ROSSI, ruling that calling someone gay is not slanderous, according to the NEW JERSEY LAW JOURNAL.
PETER MURPHY sued the station and hosts in 2008, alleging that CARTON and ROSSI, complaining about the photo MURPHY took of them for the "Best of 2006" issue of NEW JERSEY MONTHLY, falsely suggested that he was homosexual after he served them with a cease-and-desist letter blocking the use of the photo on the station's website and in fan Photoshop parodies. Judge JOEL PISANO also rejected MURPHY's copyright claims and a claim under the Digital Millenium Copyright Act of 1998.
