May 13, 2010 at 12:58 PM (PT)
Allegations against SIMMONS MEDIA's former AUSTIN cluster President have been dismissed bu the FCC and the sale of four stations in WACO, TX by SIMMONS-AUSTIN LS, LLC to M&M BROADCASTERS, LTD. has been granted for a second time. An earlier grant in OCTOBER was rescinded in NOVEMBER.
The $1.98 million sale of AC KLRK (STAR 92.9)/MARLIN, TX; Country KRQX-A and Country KRQX-F/MEXIA, TX; and Sports KRZI-A (1660 ESPN RADIO)/WACO to M&M met an informal objection from DARYL O'NEAL, former SIMMONS AUSTIN Pres. and now Pres./CEO of INDEPENDENCE MEDIA HOLDINGS, who made allegations that power-down violations at SIMMONS' Sports KSLG-A/ST. LOUIS were deliberate. The FCC ruled that the complaint was untimely and the alleged violation covered by a consent decree.
