Second Circuit Wants Supplemental Briefs On 'NYPD Blue' Nudity Case

While the Third Circuit Court of Appeals has weighed in again on the FCC's indecency rules and found them wanting, the Second Circuit is still mulling over a case involving the rules and has asked the parties in that case to file supplemental briefs explaining their views on the effect the Third Circuit ruling will have on their case. The Second Circuit case involves ABC's airing of a 2003 episode of "NYPD BLUE" in which CHARLOTTE ROSS' bare backside was fleetingly shown.
BROADCASTING AND CABLE reports that the briefs are due on AUGUST 23rd and may be no longer than 15 pages. Arguments in the case were held in FEBRUARY 2009, but no decision has been rendered. The Third Circuit ruling dealth with "fleeting expletives" but indicated that the FCC's entire indecency policy was vague.
