FCC Rejects Challenge To New Vermont Public Radio Permit

The FCC has granted VERMONT PUBLIC RADIO's application for a new noncommercial FM at MIDDLEBURY, VT, rejecting FAMILY ROSARY RADIO's Petition to Deny the VPR application and an objection filed by FAMILY, MARS HILL BROADCASTING, and NORTHEAST GOSPEL BROADCASTING, all competing applicants in the same mutually exclusive window.
The opposition arose from the grant in a subsequent window of another VPR application that became noncommercial WOXM/MIDDLEBURY, which FAMILY argued invalidated the fair distribution preference given VPR. The Commission noted that its procedure is to use data that is current as of the end of a filing window in determining preferences in competitive application pools.
