FCC Issues Guidance On Suspension Of 'Eligible Entity' Permit Extension Rule

In the wake of the Third Circuit Court of Appeals' ruling on the FCC's ownership rules, the Commission has suspended the "eligible entity" rule that had been granting 18-month extensions of the time to build expiring radio station construction permits. The Commission has now issued guidance on how the suspension will affect granted and pending applications using the procedure to gain extensions.
Grants that become final will not be affected if they become final before the Court's final decision is made. Non-final grants will revert to the original expiration date, and if construction was not completed by then, the CPs will be automatically forfeited. Pending applications in which the CP has expired will be dismissed and the permits forfeited.
