Arbitron Sues Magic Broadcasting Over Use Of Data

ARBITRON has filed suit in U.S. District Court Southern District NEW YORK against MAGIC BROADCASTING for breach of contract. ARBITRON says MAGIC hasn't been a subscriber since MARCH 31st, 2010.
ARBITRON wrote, "claims in this action result from the Defendant's continued use of ARBITRON's copyrighted reports after the expiration of a subscription agreement that entitled one or more of the Defendants to receive and use those reports."
ARBITRON claims MAGIC improperly used their information on several occasions. First, on or about AUGUST 8th, 2011, at 8p ET on WKMX, when the station used the identifier, "Thanks for making us the most listened to radio station in the WIREGRASS."
Another occasion occurred here in NET NEWS on ALL ACCESS, claims ARBITRON, when PD BILLY SEXAUER said he had, "taken the morning show from 7th in the market [DOTHAN, AL] to 1st 18-49 women." (NET NEWS 9/22)
A pre-trial conference is set for Judge DENISE COTE's courtroom on FEBRUARY 17th, 2012.
