How things are changing: With the decriminalization of possession of small amounts of pot, Massachusetts police have been told that the smell of unburnt pot is no longer a justification for a search of a car. Smoke's one thing -- you can't drive under the influence -- but since some possession of the leaves doesn't violate the law, smelling it no longer triggers probable cause. You could have a trunkload of pot ready to sell, but if it's not in plain view and the cop only smells it, carry on. (Boston Globe)
