FCC Rejects Challenge To Grant Of New Hampshire Translator

The FCC has rejected BARRY LUNDERVILLE's petition for reconsideration of the grant of a new FM translator, W251BD, at BERLIN, NH to SHAW COMMUNICATIONS, INC. to rebroadcast MT. WASHINGTON RADIO AND GRAMOPHONE Hot AC WVMJ (MAGIC 104)/CONWAY, NH.
LUNDERVILLE had contended that the translator could not get a direct off-air signal from the primary station, contravened power limits for stations within 320 km of the Canadian border, and would compete with full-power stations, all of which arguments the Commission said had already been disposed of in the initial order. He also added an allegation that MT. WASHINGTON might be supporting the translator with advertising trades with SHAW, but the Commission said that the ads do not themselves establish a rule violation.
